These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Eva Sens and its customers for purchases made on eva-sens.com. By placing an order, you unconditionally accept these terms.
1. Purpose
The GTC outline the rights and obligations of the parties for the sale of products on eva-sens.com. They apply to all orders placed by individuals or legal entities for personal or professional purposes.
2. Products
Products offered for sale are those displayed on the site, subject to stock availability. Eva Sens strives to provide accurate descriptions and visuals, but images are not contractual. If a product is unavailable after order confirmation, the customer will be notified by email and refunded within 14 business days.
3. Prices
Prices are listed in euros (€), inclusive of all taxes (VAT), excluding shipping costs. Eva Sens reserves the right to modify prices at any time, but products will be invoiced at the price displayed at the time of the order. Shipping costs are specified before order confirmation.
4. Ordering
To place an order, the customer must:
- Select products and add them to the cart.
- Provide personal information (name, address, email, etc.).
- Choose a payment method and confirm the order.
An email confirmation will be sent once the order is validated. Eva Sens reserves the right to refuse an order in case of a dispute, non-payment, or suspected fraud.
5. Payment
Payment is due at the time of ordering. Accepted payment methods are those listed on the site (credit card, bank transfer, etc.). Transactions are secured via encryption. In case of payment failure, Eva Sens may suspend or cancel the order.
6. Delivery
- Timeframe: Orders are shipped within 24 hours (business days) and delivered in 6 to 10 business days across Europe.
- Zone: Delivery throughout Europe.
- Tracking: A tracking number is provided via email.
Eva Sens is not liable for delays caused by the carrier or force majeure (strikes, weather, etc.). For defective or non-conforming products, contact support@evasens.com with photos and order number.
7. Right of Withdrawal
Under European law, customers have 14 days from product receipt to exercise their right of withdrawal without justification. To do so:
- Notify us via email at support@evasens.com.
- Return the unused product in its original packaging to the provided address.
Return shipping costs are borne by the customer, except for errors or defective products. Refunds will be processed within 14 business days after product receipt and inspection.
8. Money-Back Guarantee
Eva Sens offers a 60-day money-back guarantee for the first order, provided the product is returned unused and in its original packaging. See our Return and Refund Policy for details.
9. Liability
Eva Sens commits to delivering compliant, quality products. Eva Sens is not liable for product misuse, damage caused by the carrier, or force majeure. Products are the customer’s responsibility upon delivery.
10. Personal Data
Information collected during ordering is necessary for processing and delivery. It is protected under the General Data Protection Regulation (GDPR). Customers have the right to access, rectify, or delete their data by contacting support@evasens.com.
11. Disputes
In case of a dispute, customers should contact customer service at support@evasens.com for an amicable resolution. If unresolved, French courts have jurisdiction, and French law applies. Customers may also use the European Online Dispute Resolution (ODR) platform.
12. Modification of GTC
Eva Sens reserves the right to modify the GTC at any time. The applicable terms are those in effect at the time of the order.
